Website Policy
General
The following are the terms and conditions ("Terms and Conditions") on which we supply any of the products ("Products") listed on our www.thephotohouse.col.il website (the "Site") to you.
Please read these Terms and Conditions carefully before ordering any Product from our Site. By ordering Products from our Site, you agree to be bound by these Terms and Conditions and you will need to accept them, before completing your order, by clicking on the button marked "I Accept" at the end of the order process. If you refuse to accept these Terms and Conditions, you will not be able to order any Product from our Site.
Placing an order
By placing an order through our Site, you agree that you are legally capable of entering into binding contracts and are at least 18 years old.
When placing an order for our Products, you will be required to provide your contact details. You are required to provide true, accurate and complete details. If you provide us with false or incomplete details, we cannot guarantee that the Products will reach their destination. If the products are returned due to false or incomplete contact details, you shall be charged with the handling and delivery fees.
After placing an order for our Products, you will receive an e-mail from us acknowledging that we have received your order. This does not mean that your order has been accepted by us but it does constitute an offer to us to buy the Product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the Product has been dispatched (the "Dispatch Confirmation"). The contract between us (the "Contract") will only be formed when we send you the Dispatch Confirmation.
The Contract will only relate to those Products whose dispatch we have confirmed in the Dispatch Confirmation. If you have ordered additional Products that are not listed in the Dispatch Confirmation (for example because they are currently out of stock / unavailable), these Products will not form part of the Contract until dispatch of such Products has been confirmed in a separate Dispatch Confirmation.
We reserve the right, at our sole discretion, to withhold or refuse an order for any reason. For example, we will not accept an order until receiving an approval from the credit card company that it executed its transaction with you successfully.
Accuracy of information
We have made every effort to provide as accurate information as possible on the Site regarding our Products. However, actual Products may slightly differ from the information and illustrations we provide on the Site. Thus, the colors you see on your monitor depend on the quality of your monitor and its settings. We cannot guarantee that your monitor’s display of any color will be accurate to the real color. In addition, deviations in measurements, of up to 5%, in all Products, may occur.
Price and payment
The price of our Products is the price in force on the date and at the time on which we process your order. We make every effort to ensure that the prices on our Site are accurate.
Nevertheless, it is always possible that, despite our best efforts, some of the Products listed on our Site may be incorrectly priced. We will normally verify prices as part of our dispatch procedures, so in the event that you order a Product at an incorrect price we will cancel the order immediately and refund your payment. However we are under no obligation to provide the Product to you at an incorrect lower price quoted on our website, even after we have sent you a Dispatch Confirmation, if the pricing error is obvious and unmistakable and could have reasonably been recognized by you as a mis-pricing.
All prices include VAT.
The site accepts payments with valid Visa or Master Card credit cards only.
In addition, the site respects PayPal payments.
Delivery
Prices listed on the site do not include shipping.
The shipping cost is calculated according to the manner of shipping (Standard or Express), weight and destination, according to the Israel Postal pricelist.
Estimated delivery times:
- Israel, regular mail - 5 business days.
- Israel, express mail - 24 hours.
- Overseas, airmail - 21 business days.
- Overseas, EMS - 3 business days.
The estimated delivery times quoted above do not include the time required for producing the products. Photographs, postcards, posters, prints and other products that are produced specifically for the customer upon order, require additional time for their production. The estimated production time is ten business days.
In any case, you will be notified of the delivery date of your order in the Dispatch Confirmation.
We shall not be responsible for delay in delivery due to forces beyond our control.
Cancellation policy
Our cancellation policy for orders of products is subject to the Israeli Consumer Protection Law, 5741-1981 and the regulations made thereunder.
If you wish to return a Product, you may cancel the Contract, subject to the exceptions listed below, within 14 days after receiving the Product. To cancel a Contract, you must inform us in writing at info@thephotohouse.co.il and return the item to the following address:

We will refund the price of the Product to you as soon as possible and in any case within 14 days of the day you have given notice of your cancellation. The price of the Product shall not be refunded in full, as the delivery charges for sending the item to you are excluded from the refund. You will be responsible for returning the Product to us, in the same condition in which you received it, at your own cost and risk. You have a legal responsibility to take reasonable care of any Product whilst they are in your possession. If you return a Product that was damaged whilst being under your care, including a product that was damaged, hit, broken, or that its package was damaged, we may have a right of action against you for compensation.
In order to avoid damaging the Product, we recommend that you return the Product unused, in its original package.
Exceptions to the right to cancel an order:
• Orders of photographs, postcards, posters, prints and other products produced specifically for the customer - and which are not held in stock, cannot be canceled.
• Orders of perishable goods, which may deteriorate or be damaged until the time they are returned, cannot be canceled.
• Orders of goods which may be recorded, reproduced or duplicated, and the customer opened the original packaging, cannot be canceled.
Return policy for defective products
Our Products are checked and packaged carefully before being sent to you. However there may be the odd occasion when an item is below standard. In this case we ask you to take a picture of the defective product and email us immediately and without delay atzalmania@gmail.com.
If you received a defective product, you may cancel the Contract at any time within 14 days after receiving the defective Product. In such a case the price of the product shall be refunded in full.
Copyright
All of the copyright in the products, including the photographs, texts and graphics depicted on the products, are the sole and exclusive property of the Pri-Or PhotoHouse. By placing an order through our Site, you undertake not to use the photographs, texts and graphics depicted on the products, in whole or in part, including copying, printing, downloading, reproduction, making available to the public or making a derivative work, without the Site owner’s prior written consent. You agree to indemnify the Site owner and anyone acting on his behalf for all liabilities, claims, and expenses, including attorney's fees, which would arise from your infringement of the above undertaking.
Import duty
If you order Products from our Site for delivery outside Israel, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes and we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.
Written communications
Applicable laws require that some of the information or communications we send to you should be in writing. When using our Site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our Site. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing.
Notices
All notices given by you to us must be given to Pri-Or Photo House at info@thephotohouse.co.il. We may give notice to you at either the e-mail or postal address you provide to us when placing an order. Notice will be deemed received and properly served immediately when posted on our Site, 24 hours after an e-mail is sent, or three days after the date of posting of any letter.
Waiver and severability
If we fail to exercise any of the rights or remedies to which we are entitled, this shall not constitute a waiver of such rights or remedies.
If any of these Terms and Conditions or any provisions of a Contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will be interpreted as valid, lawful and enforceable to the fullest extent possible, and severed from the remaining terms, conditions and provisions which will continue to be valid and unchanged.
Law and jurisdiction
Contracts for the purchase of Products through our site will be governed by Israeli law. Any dispute arising from, or related to, such Contracts shall be subject to the exclusive jurisdiction of the courts of Israel in the Tel Aviv or Central districts.
